The federal appeals court has upheld a ban on deploying state troops in the Oregon city, after a latest court ruling.
The federal appeals court ruled on this week that it would rehear the legal dispute concerning the president’s authority with an larger group of 11 judges. The judicial body also vacated a earlier decision from a three-judge panel that had sided with the administration.
This legal directive represents the latest turn in a long-running court case over whether the administration has the authority and valid reason to deploy national guard forces in Portland. Approximately 200 federalized guard members have been in limbo since the end of September when the deployment effort was initiated in response to ongoing demonstrations.
The administration has argued that government employees at the ICE facility in the southern part of the city were under attack, while local authorities assert that municipal police have control of the circumstances.
Contrary to characterizations of Portland as a conflict zone, residents have been sharing footage of lush hiking trails and a vibrant culinary culture, and organizing activities such as an Emergency Naked Bike Ride against the “militarization of our city”.
The appeals court decision came after a US district judge in the city issued two temporary restraining orders this month – one blocking the federal control of the state troops, and another prohibiting the use of any national guard troops in the state, after attempts to circumvent the first order by calling up out-of-state forces.
On the previous day, the appeals court had temporarily suspended the initial decision – permitting command of state troops – but the second ruling stayed effective, preventing the actual deployment of the troops.
The latest ruling means the matter will be heard by the full court – with both rulings under consideration simultaneously – by a panel of 11 judges.
“This decision demonstrates that facts are important and that the judicial system are striving to hold this administration accountable. The founding document limits the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” said the legal representative in a official comment.
“The judicial body is sending a clear message: the president cannot send the armed forces into US cities without cause. We will continue defending state legislation, values, and autonomy as this legal proceeding moves forward and our fight continues in the judicial system.”
